Section 1031 of the Internal Revenue Code, which authorizes Tax Deferred Exchanges, is one of the most powerful Sections in the Federal Tax Code (26 US §1031). Section 1031 allows you to legally avoid/defer paying thousands of dollars in current Capital Gains and Recapture Taxes when you sell one investment property (Relinquished Property or “RQ”) and roll the proceeds into one or more Replacement Properties (“RP”).
In order to take advantage of this statute, exchange documents must be in place before you close on the sale of the Relinquished Property and you need to use a Qualified Intermediary (“QI”). Federal 1031 LLC is a QI and I have been acting
as a QI for 20 years and done over $2 Billion worth of Exchange Transactions.
